What to Do in the Event of a Claim:

In the event of damage to your building or contents, follow these steps: 

  1. Protect the property from further damage. 
  2. Call the proper authorities and utilities (e.g., gas, electric, telephone). 
  3. Take photos of the damage before having emergency repairs made, such as boarding up windows or covering holes in the roof. 
  4. Call The Liberty Company Insurance Brokers to report the loss. 
  5. Call a contractor to estimate the building damages. 
  6. Separate damaged contents from undamaged contents. Do not discard any items until the claims adjuster gives you the authority to do so. 
  7. Keep records of expenses if you are forced to temporarily relocate your business. 
  8. Do not authorize repairs until the claims adjuster has given you the authority to do so. 

After we report the claim to the insurance company, the claims adjuster will do the following: 

  1. Contact you by phone or mail to discuss the loss. 
  2. Arrange for an appraiser to inspect extensively damaged property. 
  3. Assist you with your choice of contractors to make the repairs. 
  4. Contact you for a settlement. 

After we report the claim to the insurance company, the Liberty P&C Claim Department claims will do the following: 

  1. Provide you with a claim number and adjuster information. 
  2. Designate a Liberty Claim advocate/associate to assist and/or serve as a claim advocate to ensure that your company’s interests are addressed from the beginning of the incident until closure of the claim.
  3. Ensure that your designated point of contact or the person with the most knowledge of the incident connects with the adjuster to discuss the incident and obtain supporting documentation.
  4. Provide oversight for the life of the claim to ensure that the claim is being handled appropriately and that reserves are set accordingly. 
  5. Provide your designated point of contact with monthly status updates pertaining to the development and advancement of the claim.

In the event an employee is injured on the job, follow these steps: 

  1. Evaluate the severity of the injury and determine if immediate/urgent care is required.  
  • Please Note: If the employee declines any and all care, have them fill out the medical care refusal form. “First Aid” claims can go unreported if management is willing to pay the cost for any treatment provided. The injury should be considered first aid if the employee is not expected to miss work and can be treated with only one to two visits to medical providers.  
  1. Provide the DWC-1 form to the injured worker, which must be filled out and signed by the injured worker. Management/HR will then complete the employer portion of the form. Once completed, a scanned copy should be sent to the carrier and the original filed for record keeping.  
  • Please Note: An employee must be provided with the DWC-1 form within 24 hours of being notified of the injury.  
  • In cases where the employee must be transported immediately, management must provide the form (with the employer portion filled in) and retrieve the employee’s signature as soon as reasonably possible.  
  1. Refer the employee to the designated MPN clinic for evaluation and treatment. If possible, notify the clinic that you have an employee coming in for a recent work-related injury and provide the carrier name/policy number if asked. 
  • Please Note: An Emergency Room is not the preferred destination. Sending an employee there should be used if completely necessary.  
  1. If a worker is seriously injured and needs immediate care or is transported by ambulance, the employer should have a co-worker or preferably a supervisor go with the injured employee to assist with any related information the medical provider may require. If there is a serious injury, please notify (Carrier) immediately.  
  1. Immediately report all non-first aid claims to your carrier ASAP (see cheat sheet for reporting options). Complete form 5020 (Employers report of occupational injury or illness) and submit to the carrier along with the DWC-1 if applicable. OR if reporting the claim online, the 5020 does not need to be completed as the online reporting portal will capture all of this information.  
  • Please Note: Do not wait for the employee to return the completed DWC-1 form before reporting the injury to your carrier. The form can always be provided to the adjuster at a later date. 
  1. Complete the following reports as soon as possible: Report of injury of illness, Supervisor accident report, and injury witness statement (if applicable).  

In the event of injuries or damage to property of others which you allegedly caused, follow these steps: 

  1. Call us to report the claim. 
  2. Forward any correspondence, including a summons from an attorney representing the other party. 
  3. Do not discuss the claim with the other party or their attorney. Refer them to your insurance company’s claims adjuster or to us. 

After we report the claim to the insurance company, the claims adjuster will: 

  1. Contact you to discuss the incident that allegedly caused the injury or damage to the property. 
  2. Deal directly with the other party and/or attorney to handle the claim. 

After we report the claim to the insurance company, the Liberty P&C Claim Department claims will do the following: 

  1. Provide you with a claim number and adjuster information.
